What if I Lose My Job or I am Unable to Pay Support?en español> If you lose your job, make less money than you used to, or become physically disabled and unable to earn an income, you should notify the court immediately by filing a motion to modify your spousal or partner support order. Many people who pay spousal or partner support believe that if they get behind at a time when they are legitimately unable to make a support payment, what they owe can later be reduced when an explanation is given. In fact, if you wait to modify your motion, you will be unable to reduce the back payments that you owe.
NOTE: It is very important that you notify the court by filling out the proper paperwork for a modification of your support amount. To learn how to do this, click here.
If you fill out the proper paperwork for a modification, the court may temporarily or permanently reduce the amount of your future payments.
